Apologies, but this posted topic has resulted in a threat of legal action if it is not removed, meaning it may be blocked very soon. SPW Admin p.s. Results of recent court decisions will be considered, in how they may effect forum Administrator/Moderator decisions when a litigation threat is received for a topic a visitor has started. For example, the iiNet decision regarding zero liability for results of some people using the service for questionable or illegal means. The most obvious consideration for we forum users and administrators with a topic of this nature is whether there is any realistic expectation from ANY party involved that it is fair and just behaviour that forum admins , public who build the forum content, or moderators who keep the forums as inoffensive and informative as possible with as little censoring public posts as is possible, threatened with legal proceedings by any company to force them into doing work for them to help them administer their obviously flawed copy-protecting program. Software companies have been building their own anti-piracy code since at least the early 80's and when done well by early programmers some software was truly uncopiable. If companies could find ways to do this with amazing success in 1985 with such limited resources yet still release software that was as far as anyone knew never copied, then maybe there simply needs to a change of some companies legal expenditure to copy-protecting technology expenditure, and dumping the arguably extremely arrogant notion that copy-protection should be a task for entities that receive none of the profit created when they carry out tasks for a company that they have zero affiliation with, to assist with their imperfect copy-protection methods. And even worse, under threat of litigation though they may never have even heard of the software before. Maybe you smart people reading this could help devise a truly effective copy-protection plan for current software to assist such companies so they no longer require legal threats for their copy protection, which would be of benefit all-round. Looking at the copy-protection techniques used in the early 80s for Apple II computers might be a good place to begin. Nibble was a disk-copy program that was the most effective software created then, and would break all known software copy-protection, yet within weeks it was made redundant by newer copy-protection methods. It was unthinkable to give up, and just rely on legal threat, and maybe those more noble times for programmers and software companies should be given another try. Any ideas from this topics visitors that could help resolve this long-standing problem would be great. We do need to decide rather quickly if possible, but don't let that stop you giving suggestions on how this could be improved in future, for the benefit of everyone. I dont know about you, but its a very interesting topic. Like spam-blocking, it might be an annoying problem to be forced to counter, but that doesn't mean it isn't also a great game of logic and amazing solutions that rewards the forum developer every time another percentage of their incoming spam is successfully blocked. Copy-protection could be interesting and rewarding rather than an ugly legal problem. Over to you. Regards. SPW - Admin |

Admin, you are correct with your stance. I understand moncom.net forums are mostly or wholly Australian owned. The iinet decision in Australian courts mirrors the problem here. You are running a service that may be used by some visitors that do wrong or do things that are perceived as wrong by software companies, for which you cannot be held liable. Your statement that it will take extra work on behalf of one or more software companies to maintain their flawed anti-piracy systems is another matter altogether. It is crazy for any company to think they can force another to do this work for them. Its up to them to work on their registration system, no one else. It must surely be only their responsibility to maintain or repair their anti-piracy systems if they are not operating as well as they would like them to. Perhaps if a company wants your moderators to do this work for them, they should pay for the work done on their behalf. Just a thought. Interesting situation to consider. But can you imagine any court demanding your unpaid moderators do work for a seperate company just because they expect it? I don't think so. |

I hear you Sven. Thanks for your input. Another important point to make is that topics such as this have been shown to always make sales of the software in question. I wonder if such companies realise this. If they checked where their spike in sales has come from, they will find that their purchasers links leading to their sales pages starts in a topic such as this. Companies are realising this and posting their own serials. It seems counterintuitive, but I guarantee this topic has increased sales of the relevant software, not decreased sales. Hopefully they track the pages their buyers come from, so they can see this for themselves. Our own link-tracking shows this to be true. Sales have come from this topic, and other similar topics have shown the same thing. |
